Biography

Adv Funeka Thema is a legally qualified adult female with B Proc and LLB degrees from the University of Limpopo and the University of Pretoria obtained in 1994 and 1996 respectively.


Adv Thema has in her early working days, worked for various human rights organisations including the SA Human Rights Commission until 2003.


She was admitted as an Attorney of the High Court in 2005. Between 2004 and early 2007, Adv Thema worked for several law firms in and around Pretoria including Mothle Jooma Sabdia Inc and Makhafola and Vester Inc where she gained practical legal experience specialising in property law, labour and general litigation.


In March 2007, Adv Thema joined the Department of Justice and Constitutional Development (DOJCD) as a Project Manager to assist in the transformation of Small Claims Courts to ensure access to justice and increase Small Claims Courts footprints in the previously disadvantaged communities. Adv Thema’s skills and knowledge on public service, public financial management, human relations and good governance were harnessed during her 8 (eight) years of service with the DOJCD. She left the department in December 2015 to pursue her career in advocacy.


In January 2016, Adv Thema joined the Johannesburg Society for Advocates (JSA) as a pupil member and was subsequently admitted as an Advocate of the High Court in May 2016. She completed her pupillage in November 2016 and started practising as an Advocate in December 2016 at Thulamela Group in Sandton.


In 2021, Adv Thema joined the Tshwane Society of Advocates (TSA) as a full-time member to date.


Adv Thema’s particular interest in law is labour and employment law, property law, constitutional law, public administrative law, corporate governance and compliance, alternative dispute resolution and general civil litigation.


In 2017, Adv Thema was appointed as a Mediator for rental housing disputes for the Gauteng Department of Human Settlement (Rental Housing Tribunal). She served as such until March 2023. In June 2023, she was appointed as a Member of the Tribunal for the Gauteng Rental Housing Tribunal where she is presiding and adjudicating upon rental housing disputes and draft rulings and orders at the end of the Tribunal hearings.


In January 2023 to date, Adv Thema serves as a member of the Investigation and Disciplinary Committees of the Legal Practice Council (Gauteng Provincial Office).


In March 2024 to date, has been presiding over conduct inquires of the Health Professions Council of South Africa (HPCSA) either as chairperson or a member of the Committee.


Adv Thema serves as Deputy Treasurer of the Board of Tshwane Society of Advocates since August 2023.


Adv Thema’s litigation experience since her admission as both an attorney and advocate, in all her areas of interest includes amongst other things drafting of court papers, court appearances, advisory, chairing of disciplinary hearings etc.
